Terms of sale

1. Purpose
These terms govern subscriptions to the Frondel service, published by Tendances SEO (SARL, 7 Rue Nicolas De Staël, 84000 Avignon, France, business ID 101 556 835 00011, Avignon Trade Register, VAT FR16101556835).
2. The service
Frondel is a subscription content management service allowing the subscriber to create, edit and publish websites. The features included in each plan are those described on the pricing page on the day of subscription.
3. Free trial
New subscribers get a 7-day free trial. Payment details are collected at sign-up but no charge is made before the end of the trial. Cancelling during the trial ends the subscription with nothing to pay.
4. Prices and taxes
Prices are those displayed at the time of subscription, excluding tax. Applicable taxes are calculated and added at checkout. Sales and billing are handled by our authorised reseller FastSpring (FastSpring, Inc., acting as merchant of record), which appears as the seller on your statement and invoice. FastSpring's terms apply to the payment transaction, and FastSpring collects and remits the applicable taxes (VAT, US sales tax, etc.).
5. Payment and renewal
The subscription is billed monthly or yearly in advance and renews automatically for the same period unless cancelled. Extra sites and extra users are billed on the following invoice.
6. Cancellation
The subscriber may cancel at any time from the account. Cancellation takes effect at the end of the period already paid for, which is not refunded on a pro-rata basis.
7. Right of withdrawal
The service is intended for business customers: the right of withdrawal does not apply to business subscribers. Any mandatory rights that would apply to a customer not acting for business purposes remain reserved.
8. Availability and support
Tendances SEO undertakes to use reasonable efforts to keep the service available, without guaranteeing uninterrupted operation. Maintenance may cause temporary interruptions.
9. Content and ownership
The subscriber remains the owner of the content and templates published through the service, and may export them at any time. The subscriber is responsible for the lawfulness of what is published.
10. Liability
Tendances SEO's liability is limited to direct and foreseeable damages and may not exceed the amounts paid by the subscriber over the last twelve months. Indirect damages (loss of data, revenue or business) are excluded.
11. Personal data
Data processing is described in the privacy policy.
12. Applicable law
These terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the courts of Avignon (France), subject to mandatory rules protecting consumers.
13. AI features (subscriber's keys)
The artificial-intelligence features (assisted writing, image generation, chatbot) rely on the API keys the subscriber provides themselves (“BYOK”). Their usage is billed directly to the subscriber by the chosen AI provider, outside the Frondel subscription; the publisher does not resell AI credits and is not responsible for those providers' prices, availability or outputs. Supported providers: OpenAI, Anthropic (Claude), Google (Gemini) and Perplexity, whose respective terms and prices apply.
14. Support and access to the workspace
To provide the requested support, the publisher may access the subscriber's admin workspace and act on their behalf. Such access is restricted to the publisher's support team and is logged. Such access takes place only for support purposes, is restricted to the publisher's authorised staff, and the corresponding logs are kept for twelve months. In no event does the publisher's staff have access to the subscriber's password.
15. Chatbot and visitor data
If the subscriber enables the chatbot on a published site, questions asked by visitors are sent to the subscriber's AI provider to produce a reply. The subscriber is responsible for informing visitors and for processing this data. This processing is detailed in the subscriber's Privacy Policy.
16. Refund policy
The service is intended for business customers; accordingly, the consumer right of withdrawal does not apply. A 7-day free trial lets you evaluate the service before any payment. As a result, amounts paid for a subscription period already started are non-refundable. You may cancel at any time to prevent renewal: your access remains active until the end of the period already paid. Requests may be sent through our contact form; payments and any refunds are handled by our authorised reseller FastSpring (merchant of record). Any mandatory rights that would apply to a customer not acting for business purposes remain reserved.
